I got hit two weeks ago by a lady who was clearly at fault. I was fine at the time, told her I’m not going to sue, yadda yadda. She gives me a card, tells me to call her if anything changes.
Give her a call once I realize she took a huge chunk out of my rim. She told me to (in nicer terms) fuck off and now won’t return any of my messages. I have no recourse because I thought I was being a nice guy by not calling the cops or anything.
I wish I’d gotten a plate number when I got hit last week (the week before? I don’t remember)
I could have gotten acupuncture or a chiropractor or something out of it, probably

seriously. the best would be to find one that works on commission(?)–basically, he only gets money if he wins the case. he gets a certain percentage if he wins, nothing if he loses. i know a dude around here named andy fischer is pretty awesome; though i don’t know if he’d work outside massachusetts.
but seriously. the insurance folks are going to try to fuck you so hard.
When I saw this thread and who the author was, I immediately wailed out. I have always had a massive crush on your bike and seeing it so messed up, really upset me. I’m glad you’re alright and I’d take the advice of others, and find a lawyer. I’m sure the jerk that hit you has no idea how much that bike or wheel are worth, and will probably put up a fight.
Get a lawyer. Like Braden said, you don’t know if you’re actually injured or not for a couple weeks, even months sometimes. You could still be in a mild shock. Unless you’re completely sure you’re OK, I would get checked out anyway. Also, I’ll say it again, get a lawyer.
PS, I did a thread like this when I got hit and a few people said it might not be best to have all the info on the web with legal stuff pending. Just some advice. Glad you’re not seriously injured.

If lawyers are involved, make sure the driver’s don’t see the lack of a brake in that picture. I am not saying that it had anything to do with the accident or dredging up the whole brake issue for debate, but I can’t imagine it will help you if it becomes contested.
Oh, you’re going to have to anyway, but go get an estimate from a shop. They’re going to need it for property damage. Try to go to a cool shop that will be real about what’s fucked(probably just call the bike totaled). And make the shop is reputable and get it in writing.

Wow, really glad to hear you didn’t get wrecked along with the bike. You definitely want to get estimates ASAP. A good friend of mine got hit in December and still hasn’t seen any money from the guy who hit her. Insurance companies will do anything in their power to make the process as complicated and time consuming as possible. As other people have said, don’t make any concessions, especially if the driver was in the wrong. Take care and good luck.
